Jurisdictional Analysis of the Physical Rights of the Fetus in Ceremonial Delivery

Abstract
Background and Objective: Sometimes, parents wish to register the birth of their child on a specific date, leading them to request early delivery without a valid medical reason. From a medical perspective, intervening in the timing of delivery poses risks and complications for the fetus. This raises the question of whether it is justifiable to endanger the life and health of the fetus for the sake of a ceremonial delivery.
Methods: This research is descriptive and analytical. In this research, verses of the Qur’an and narrations were utilized for the extraction and compilation of the material. The authors of the article reported no conflict of interest.
Results: Changing the delivery date to coincide with specific occasions can severely jeopardize the "right to life" and "right to health" of the fetus, resulting in serious health consequences.
Conclusion: Scientific studies and investigations indicate that the deliberate alteration of the delivery date can pose serious and potential risks to the health and life of the fetus. Parents do not have the right to jeopardize the physical well-being of the fetus by choosing the timing of birth arbitrarily. Therefore, changing the delivery date to coincide with specific occasions is not consistent with medical and jurisprudential principles and is considered impermissible.
