مبانی تعهد اطلاعرسانی پزشک به بیمار نسبت به مخاطرات درمان

چکیده
زمینه و هدف: در سالهای اخیر، تعهد اطلاعرسانی پزشک به بیمار نسبت به مخاطرات درمان، به عنوان اصلیترین و مناقشهانگیزترین بخش از اندیشه رضایت آگاهانه در نظامهای حقوقی مختلف مورد توجه و بررسی قرار گرفته است. هدف از این مطالعه، تحلیل مبانی تعهد پزشک به اطلاعرسانی به بیمار در خصوص مخاطرات درمان در نظامهای حقوقی و ارزیابی آنها به منظور یافتن مبنایی مناسب در حقوق ایران است.
مواد و روشها: این مطالعه، یک مرور کتابخانهای به روش توصیفی ـ تحلیلی و با رویکرد تطبیقی است. ابتدا متون موجود در زمینه تعهد اطلاعرسانی پزشک به بیمار نسبت به مخاطرات درمان در نظامهای حقوقی آمریکا و فرانسه، مورد مطالعه قرار گرفته و تلاش شده است تا با تحلیل مباحث مطرحشده، مبنای این تعهد استخراج و تبیین گردد.
یافتهها: نظام حقوقی آمریکا، تعهد اطلاعرسانی پزشک در خصوص مخاطرات درمان را به عنوان لازمه خودمختاری بیمار محسوب نموده و برای آن ماهیتی ذاتاً حقوقی قائل میباشند، ولی در نظام حقوقی فرانسه آن را از ضروریات تأمین کرامت و منزلت انسانی برمیشمارند و برای آن ماهیتی ذاتاً اخلاقی قائل هستند. در کنار این مبانی، اندیشههای مصونیت جسم انسان و حسن نیت نیز در برخی نظامهای حقوقی مطرح شدهاند. با توجه به مبانی فقهی و اخلاقی حقوق ایران، پذیرش اندیشه کرامت ذاتی انسانی به عنوان مبنای نظری تعهد اطلاعرسانی پزشک به بیمار، با حقوق ایران سازگارتر است.
ملاحظات اخلاقی: گزارشدهیها و استناد به مقالات و متون مورد استفاده، مبتنی بر صداقت و امانتداری و با ذکر منابع مورد استفاده و بدون هرگونه سوگیری و یا تحریف یافتهها میباشد.
نتیجهگیری: پذیرش مبنای اخلاقی، یعنی کرامت ذاتی انسانی برای تعهد اطلاعرسانی پزشک به بیمار در خصوص مخاطرات درمان و اقامه دعوی مسؤولیت پزشک بر مبنای تقصیر اخلاقی، میتواند زمینه را برای جبران کامل خسارات مادی و معنوی بیمار فراهم نماید.
