کاهش جنین و مسؤولیت‌های ناشی از آن در نظام حقوقی ایران

Abstract

از آنجا که کاهش جنین محصول پیشرفت علم و تکنولوژی پزشکی در زمینه درمان ناباروری است و سابق بر این موضوعیتی نداشته، به همین دلیل حکم شرعی و فقهی مشخصی برای آن وجود ندارد.

الزام پزشکان متخصص ناباروری برای اقدام به چنین اعمال پزشکی، درمانی، این چالش فقهی و حقوقی را در پی دارد که اساساً این اقدام از سوی پزشک، مسؤولیت‌هایی را از جنبه مدنی، کیفری و انتظامی برای وی به دنبال خواهد داشت یا خیر؟ از این رو با توجه به اهمیت و ضرورت مقوله کاهش جنین و نیز با توجه به لزوم آگاهی از حقوق، تکالیف و مسؤولیت‌های محتمل مرتبط با آن، در مطالعه حاضر سعی بر آن است تا موضوع مسؤولیت‌های سه‌گانه پزشک در ایران، ناشی از عمل کاهش جنین، مورد واکاوی قرار گیرد.

بر این اساس، در ابتدا به تعریف کاهش جنین، انواع آن، روش‌های رایج و نیز رویکرد نظام حقوقی دیگر کشورها در این خصوص پرداخته و سپس به بحث مسؤولیت‌های سه‌گانه پزشک ورود کرده و در ذیل معرفی هریک از مسؤولیت‌های مدنی، کیفری و انتظامی، مسؤولیت‌های پزشک ناشی از عمل کاهش جنین مورد بررسی قرار خواهد گرفت.
