Ensuring Global Coexistence (the Right to a Healthy Environment) in the Context of Green International Criminal Policy

Abstract
Background and Aim: The commission of anti-green crimes by natural or legal persons is increasing and endangers global coexistence (the right to a healthy environment), so that the United Nations has acted as an international actor and by approving binding documents has expressed his concern in this regard. In the current research, environmental discriminatory criminal policy is investigated from the perspective of the United Nations and its localization in Iranian law.
Methods: The research is applied in terms of type and purpose and descriptive in terms of nature and method and information was collected through document review and data collection.
Ethical Considerations: Scientific honesty and trustworthiness have been observed in all stages of writing the research.
Results: The proposed strategies are clearly visible at two levels, supra-legislative and legislative. These strategies have been proposed in some domestic laws as well as in some international documents by the activists of the international community and by localizing them, a valuable step can be taken towards an efficient criminal policy.
Conclusion: Preventive policies against environmental crimes can be seen in the form of individual-oriented and situation-oriented preventive policies. Regarding the substantive criminal strategy, we can refer to the green differential criminalization strategy. In the field of formal criminal law, strategies can be identified and introduced. Of course, green restorative strategies can also be mentioned in environmental criminal policy.
