مطالعه زیستفناوری تأثیر اختلال طیف اوتیسم و نشانگان جنین الکلی بر استعداد ارتکاب جرم در کودکان

چکیده
زمینه و هدف: امروزه به کمک تکنیکهای زیستفناورانه علوم اعصاب و ژنتیک، دانش حقوق دستخوش تحول شگرفی شده است، از جمله میتوان به استعانت بر یافتهها و شواهد نوین زیستی در رابطه با جرمشناسی کودک اشاره کرد. کمتوانی ذهنی (یا عقبماندگی ذهنی) اصولاً امارهای بر عدم رشد عقل کودک است که میتواند در نتیجه اختلالات طیف اوتیسم و نشانگان جنین الکلی ایجاد شده و بعضاً آنان را مستعد ارتکاب جرم سازد. در مقاله حاضر برآنیم تا با مطالعه میانرشتهای زیستفناوری و جرمشناسی، این دو اختلال شایع در کودکان را مورد تجزیه و تحلیل قرار داده و جوانب آن را برای دادرس تبیین نماییم.
روش: پژوهش حاضر از نوع نظری به روش توصیفی ـ تحلیلی میباشد و روش جمعآوری اطلاعات آن به صورت کتابخانهای است که با مراجعه به اسناد، کتب و مقالات صورت پذیرفته است.
ملاحظات اخلاقی: در تمامی مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: در اغلب کودکان مبتلا به نشانگان جنین الکلی و اوتیسم، ناهنجاری رفتاری پدید میآید که ریشه عصبشناختی دارد. این ناهنجاریها در نتیجه اختلال در برخی نواحی خاص مغز برای پردازش احساسات و ادراک دیگران رخ میدهد و زمینهساز بروز رفتارهای ضد اجتماعی و مجرمانه در فرد میشود.
نتیجهگیری: بسیاری از کودکان مبتلا به نشانگان جنین الکلی و اوتیسم به سبب ضعف توان شناختی و یادگیری، مستعد ارتکاب جرم هستند. مهمترین ابزار زیستفناورانه برای ارزیابی تأثیرات این دو اختلال در کودکان، سنجش مغز اجتماعی آنان به طریق تکنیک fMRI است.
