رعایت حریم منزل، مکاتبات و مکالمات در رویه دیوان اروپایی حمایت از حقوق بشر با نگاهی به قانون آیین دادرسی کیفری ایران

چکیده
حریم خصوصی مفهومی است رایج، اما تقریبا ناشناخته بدین معنا که تعریف دقیق و جامعی از آن ارائه نشده است. در ماده 8 از کنوانسیون اروپایی حمایت از حقوق بشر نیز بدون آنکه تعریفی از این واژه به عمل آید، مصادیق این حریم تحت عناوین زندگی شخصی، زندگی خانوادگی، منزل و مکاتبات معرفی شدهاند. دیوان اروپایی حمایت از حقوق بشر به عنوان نهاد مفسر کنوانسیون، ضمن توسعه مصادیق منزل و مکاتبات مندرج در ماده 8 به دولتهای عضو این کنوانسیون اجازه داده است که بر مبنای حمایت از جامعه در مواقع ضروری، مطابق با قانون و در راستای اهداف تعیینشده در ماده مزبور مبادرت به مداخله در حریم منزل و مکاتبات افراد نمایند، هرچند تفاسیر ارائهشده و رویه قضایی دیوان اروپایی در این زمینه بیانگر این نکته میباشد که در تقابل حقوق افراد با منافع جامعه، برتری به نفع حقوق افراد رقم خورده است. در مقاله حاضر به شیوهای توصیفی ـ تحلیلی با در نظرگرفتن آرای صادره از دیوان اروپایی حمایت از حقوق بشر و با هدف مقایسه آن با مقررات آیین دادرسی کیفری ایران در زمینه حریم منزل، مکاتبات و مکالمات به این نتیجه دست یافتهایم که هرچند قانونگذار ایران تلاش نموده پایبندی خود را به رعایت حقوق افراد نشان دهد، اما مبهمبودن برخی عبارات و اختیارات گسترده اعطاشده به مقام قضایی باعث در معرض خطر قرارگرفتن حقوق و آزادیهای افراد گردیده و از این حیث نیازمند اصلاحاتی در قانون آیین دادرسی کیفری از جمله اصلاح ماده 60 در زمینه تعیین ضمانت اجرا برای کلیه تخلفات نیروی پلیس، اصلاح ماده 140 در جهت توسعه مصادیق تفتیش شبانه و اصلاح ماده 144 در زمینه تعیین مصادیق حضور نیروی نظامی است.
