Abstract
Background and Objective: The civil legislator has not only not provided any enforcement guarantee for the wife's sexual rights in cases of a husband suffering from a disease, a disease, or sexually transmitted diseases, but also, in the second paragraph of Article 1122 of the Islamic calendar regarding a defect in the husband's health, has considered the occurrence of a marital act only once as an obstacle to establishing the wife's right to terminate the marriage In the third paragraph of the article mentioned in the article on male genital mutilation, the lack of power of the man over the marital act is considered a condition for the dissolution of the marriage, and in Article 1127 BC, the husband's infection with sexually transmitted diseases is considered a reason for the wife's right to prevent intercourse without also mentioning her sexual rights. . Given the importance of the wife's sexual consent and its relationship with marital satisfaction and mental health, the need for the legislator to review the aforementioned articles becomes apparent. In addition, the legislator's supportive approach to the wife's sexual rights and the provision of enforcement guarantees can prevent disasters such as marital infidelity.Materials and Methods: The present article has used a descriptive-analytical method to collect information through library resources using the file-taking method. Findings: From the study of jurisprudential texts related to articles 1122 and 1127 BC, as well as the study of psychological findings on the importance of sexual satisfaction in marital life, it was found that in the event of a couple suffering from a disease, the clause "one-time occurrence of a marital act" And in the case of a male genital mutilation, the clause "the man's power to perform the marital act" in abolishing the wife's right to terminate the marriage is inconsistent with the wife's sexual rights, including sexual consent, and consequently with her mental health. In cases where the couple suffers from sexually transmitted diseases, it is also necessary to assume the right to seek divorce in order to protect the wife's sexual rights - after the usual medical period has passed in treating the man's illness or after treatment has failed.
