تحولات تاریخی تمتع متهمان به ارتکاب اعمال تروریستی از حق بر دادرسی عادلانه با تأکید بر پرونده عمر خضر در محاکم کانادا در پرتو حقوق نرم بشردوستانه بینالمللی

چکیده
زمینه و هدف: با گسترش عملیاتهای تروریستی پس از حملات یازده سپتامبر، در فرآیند مبارزه با فعالیتهای تروریستی، بنا به دلایل مختلف از جمله فقدان ابزارهای کنترلی و وضعیت خاص نیروهای تروریستی نسبت به مردم عادی، برخی از دولتها رویههایی را در جهت عدم تمتع متهمان به ارتکاب اعمال تروریستی از برخی مصادیق حقوق بشر و حقوق بشردوستانه از جمله حق بر دادرسی عادلانه ایجاد نمودند.
مواد و روشها: این تحقیق از نوع نظری بوده روش تحقیق به صورت توصیفی ـ تحلیلی میباشد و روش جمعآوری اطلاعات به صورت کتابخانهای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.
یافتهها: رویههای جدید مورد انتقاد شدید نویسندگان، حقوقدانان و حتی بازیگران غیر دولتی مانند صلیب سرخ قرار گرفت. این انتقادات موجب شد که اسناد غیر الزامآور مهمی در این زمینه از سوی ملل متحد طراحی و تصویب شوند. اسناد غیر الزامآور مزبور در جهت تفسیر و تقویت هنجارهای سخت موجود حرکت کردند.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
نتیجهگیری: در تحلیل رویه محاکم ملی در مواجهه با حقوق نرم بشردوستانه دو فرض مختلف متصور است: در فرض اول، الگوی رفتاری محاکم ملی در مواجهه با فضای حقوق نرم، از جانب سایر محاکم ملی در قلمرو کشورهای دیگر نیز به مورد توجه قرار میگیرد و این رفتار محاکم ملی به واسطه تکرار، عملاً مبنایی مناسب برای شکلگیری هنجارها و قواعد عرفی بینالمللی را فراهم میکند؛ در فرض دوم، محاکم ملی در برابر شکلگیری هنجارها و قواعد عرفی جدید مقاومت میکنند. به بیان سادهتر، هنجارها و مقررات نرمی که توسط سایر محاکم در ادبیات حقوق بینالملل مطرح شده است را به واسطه غیر الزامآوربودن و تعارض با برخی اصول و قواعد سخت موجود، اجرا نمیکنند.
