بررسی و نقد دیدگاه وارن در باره تولد به مثابه ملاک و معیار منزلت اخلاقی جنین

چکیده
درباره سقط جنین از منظر اخلاقی سه دیدگاه لیبرالی، محافظهکارانه و اعتدالی مطرح شده است. بر اساس دیدگاه لیبرال، سقط جنین در هر زمانی از دوره بارداری و به هر دلیلی اخلاقاً مجاز است. مری آنه وارن یکی از مدافعان این دیدگاه است. وارن استدلال سنتی بر مجازنبودن سقط جنین را به دلیل عدم تکرار حد وسط عقیم میداند و معتقد است انسان در دو مقدمه استدلال به یک معنا به کار نرفته است؛ انسان در مقدمه اول به معنای زیستشناختی است و در مقدمه دوم به معنای انسان اجتماعی است که وارن آن را شخص مینامد. وارن پنج معیار برای تمایز میان انسان و شخص ارائه میدهد و معتقد است جنین انسان و حتی نوزاد تازه متولدشده فاقد ویژگیهای شخصبودناند. او تولد را ملاک کسب حقوق برابر اخلاقی دانسته و سایر معیارهای ارائهشده از جمله آگاهی، نخستین حرکت جنین در رحم مادر، احساس و زیستپذیری را رد میکند، گرچه در منابع انگلیسی تا حدودی به نقد و بررسی دیدگاه وارن پرداختهاند، ولی در منابع فارسی نه تنها به تولد به مثابه ملاک و معیار منزلت اخلاقی توجهی نشده، بلکه دیدگاه وارن نیز مورد نقد و بررسی قرار نگرفته است. در این مقاله به بررسی و نقد دیدگاه وارن درباره تولد به عنوان ملاک برابری اخلاقیبودن سقط جنین پرداخته و مشخص خواهد شد که جنین از لحظه لقاح واجد حقوق اخلاقی میشود نه هنگام تولد.
