بررسی تطبیقی حقوق مصرفکنندگان محصولات تراریخته در ایران و اتحادیه اروپا

چکیده
زمینه و هدف: حمایت از حقوق مصرفکننده در برابر کالاهای تولیدی اهمیت به سزایی دارد، به گونهای که در حقوق جدید و مدرن مسؤولیت سنگینی برای تولیدکنندگان در نظر گرفته شده است. با این همه نخستینبار قانونگذار اصطلاح «مصرفکننده» را در دهه هشتاد شمسی و در سال 1382 و سپس در سال 1388 تعریف کرد. در همین دهه نیز نخستین محصول تراریخته تولید شد و ضرورت قانونگذاری در حوزه محصولات تراریخته و حمایت از مصرفکننده را بیشتر کرد.
مواد و روشها: این نوشتار ضمن مقایسه تطبیقی قانون ایمنی زیستی با مقررات اتحادیه اروپا به دنبال بازتاباندن کاستیها و خلأهای قانون ایمنی زیستی در خصوص حقوق مصرفکنندگان محصولات تراریخته میباشد.
یافتهها: گرچه «قانون ایمنی زیستی» در سالهای پایانی دهه 1380 با الگوبرداری از قوانین روز نوشته و تصویب شد، ولی در مقایسه با قوانین و مقررات اتحادیه اروپا کاستیهایی در آن دیده میشود که گذشت دو دهه از عمر این قانون و تحولات سریع حوزه زیستفناوری به ویژه تولید هرچه بیشتر محصولات تراریخته و تجاریسازی آن ضرورت اصلاح آن را دوچندان مینماید.
نتیجهگیری: قانون ایمنی زیستی ایران بر خلاف مقررات اتحادیه اروپا، محصول تراریخته معیوب یا ناقص را تعریف نمیکند و نظام جبران خسارت و نحوه جبران خسارت را روشن نمیسازد و از این جهت نمیتوان انتظار داشت که حقوق مصرفکننده به درستی حمایت شود.
