نگرشی اخلاقی ـ حقوقی به جایگاه اصل برابری در حقوق کودکان با نیازهای ویژه

چکیده
زمینه و هدف: کودکان با نیازهای ویژه از جمله افرادی هستند که بنا بر ویژگیهای جسمی و روانی خاص خود، نیازمند دریافت آموزشها، تسهیلات و حمایتهای خاص میباشند. هدف این مطالعه تحلیل اخلاقی ـ حقوقی قوانین ایران از منظر جایگاه اصل برابری در حقوق کودکان با نیازهای ویژه است.
مواد و روشها: در این مطالعه تحلیلی ابتدا قوانین مرتبط به حقوق کودکان استثنایی در ایران به صورت هدفمند جستجو شده و پس از بررسی و تحلیل اخلاقی و حقوقی این قوانین، شکافهای قانونی مشخص گردید.
یافتهها: اگرچه در قوانین ایران به طور خاص به کودکان دارای نیازهای ویژه و حقوق آنها اشاره نشده است، با این حال، با جستجو در قوانین مختلف، میتوان نمونههایی از توجه قانونگذار به این کودکان را ملاحظه کرد که ذیل دو عنوان برابری از حیث حقوق اجتماعی و حقوق کیفری قابل تبیین است. در خصوص برابری از حیث حقوق اجتماعی، تمرکز بر جنبه ایجابی و فراهمآوردن امکاناتی به منظور پرورش استعدادها و قابلیتهای این کودکان است. در خصوص برابری از حیث عدالت کیفری نیز هدف قانونگذار حمایت از کودکان استثنایی در برابر بزهدیدگی و سوء استفاده است.
نتیجهگیری: علیرغم وجود سیاستهایی برای اعمال برابری و عدم تبعیض در زمینه حقوق کودکان با نیازهای ویژه در قوانین ایران، شکافهای متعددی در این خصوص وجود دارد. اتخاذ سیاستهایی نظیر بازتعریف مفهوم کودکان با نیازهای ویژه، گنجاندن مقررات صریح و معین برای حفاظت از حقوق این کودکان، ذیل قوانین مربوط به کودکان و تدوین سیاستهای افتراقی در فرآیند رسیدگی کیفری به جرائم ارتکابی علیه این کودکان توسط قانونگذار توصیه میگردد.
