موافقتنامه منع تجارت متقلبانه و دسترسی به دارو در کشورهای در حال توسعه

چکیده
زمینه و هدف: از میان موافقتنامههای موجود در حوزه حقوق مالکیت فکری، موافقتنامه منع تجارت متقلبانه (آکتا) بالاترین سطح استانداردهای اجرایی را مقرر نموده است. هدف مطالعه حاضر، شناخت نوآوریهایی مقررات آکتا نسبت به سایر مقررات بینالمللی در حمایت از حقوق مالکیت فکری و اثرات این نوآوریها بر دسترسی به دارو در کشورهای در حال توسعه میباشد.
مواد و روشها: در این تحقیق کیفی از روش تحلیل سند استفاده شده است. این روش با تحلیل ویژگیهای موافقتنامه آکتا، تأثیر آن بر دسترسی به دارو در کشورهای در حال توسعه را مورد بحث و بررسی قرار میدهد.
یافتهها: دامنه وسیع حمایت از حقوق مالکیت فکری در این موافقتنامه، با حذف انعطافپذیری موافقتنامه تریپس، عدم شفافیت و مشارکت لازم در جریان مذاکرات و گسترش تعریف کالاهای تقلبی و تعمیم آن به داروهای ژنریک، تأثیرات جبراننشدنی بر دسترسی به دارو و سلامت عمومی در جوامع در حال توسعه، برجای خواهد گذاشت. این موافقتنامه، احتمال توقیف نامشروع کالاها و طرح دعاوی واهی حقوقی علیه تولیدکنندگان داروهای ژنریک را افزایش میدهد و این امر افزایش امکان توقیف کالاها، افزایش قیمت و کمیابشدن دارو در کشورهای در حال توسعه و تهدید سلامت عمومی را به دنبال خواهد داشت.
نتیجهگیری: موافقتنامه آکتا میبایست به گونهای تفسیر و اجرا گردد که حق کشورهای متعاهد بر سلامت و دسترسی همگان به دارو مورد حفاظت قرار گیرد، به گونهای که هرگاه دسترسی دارویی، متضمن نقض حقوق مالکیت فکری باشد، از طریق اعمال رویهای واحد، از توقیف بینالمللی این داروها و عدم دسترسی به آنها جلوگیری شود.
