بهرهگيري از رهيافتهاي حقوق بینالملل در جهانيسازي اخلاق زيستي

چکیده
تبعیض میان حقوق بشر و حقوق دیگر موجودات چون حیوانات و حقوق محیط زیست در دهههای اخیر با بهرهگیری از نگاه تجربهگرای غرب و در عین حال تعامل با سنن و فرهنگهای رقیب ـ که ارزش و احترامی ذاتی برای سایر موجودات قائل بودهاند ـ در حال کمرنگ شدن است؛ با این حال پیداست که در این فاصله و تا پیش از تحقق عینی این باور محیط زیست و در تحلیل نهایی انسان خسارتهای غیرقابل جبرانی متحمل شدهاند. این همه در شرایطی است که در حقوق بینالملل مدرن و برخی فرهنگها تنها «انسان» و حقوق او مورد توجه و تأکید نبوده و برای جهان پیرامون و در واقع شرکای انسان در این جهان نیز ارزش و حقوقی ذاتی قائل بودهاند؛ دیدگاهی که اگر با درکی متقابل از سوی غرب به عنوان خاستگاه اصلی حقوق بینالملل مورد توجه قرار میگرفت، دست کم برخی مشکلات زیستمحیطی امروز را شاهد نبودیم. در این نوشتار جهانیسازی اخلاق زیستی، اهمیت و ضرورت مفاهمه و تعامل مؤثر میان فرهنگهای مختلف در عرصهی حقوق بینالملل و بهرهگیری از رهیافتهای آن در حوزهی اخلاق زیستی مورد تأکید نگارندگان است.
